Golfers Gym curriculum Participation Agreement.

This Participation Agreement (“Agreement”) is entered into on this day by and between the Youth Golfers Outreach Program, hereinafter referred to as “YGOP”, with principal offices located in Kentucky, USA, and:
    ​Collectively referred to as the “Parties.”
    1. Program Overview
    The Golfers Gym Program is a school-based health, wellness, and physical education initiative created by YGOP. It integrates physical activity, nutrition education, character development, and the sport of golf to support healthy lifestyles in youth.
    This program is delivered under YGOP’s $1 A Day Program Model, which aims to provide high-impact educational and fitness tools at a low cost. In line with its “Pass It On” system, participating schools agree to advocate for and support the introduction of the program in at least one other school or district during or after implementation.

    2. Scope of Participation
    By signing this Agreement, the Applicant agrees to:
    • Implement the Golfers Gym curriculum, digital tools, and program materials in a timely, consistent, and compliant manner within the registered school or institution.
    • Submit all required documentation, including a high-resolution school logo for customization purposes.
    • Participate in any virtual or in-person training sessions provided by YGOP to ensure proper program delivery.
    • Assign a school-based point of contact or coordinator to liaise with YGOP during implementation.

    3. Term of Agreement
    This Agreement shall commence on the date it is signed by both Parties and will remain in effect for a period of twelve (12) months, unless terminated earlier pursuant to Section 10 of this Agreement. The Agreement may be renewed upon mutual written consent.

    4. Intellectual Property Rights
    All program materials, branding, media content, curriculum, games, video content, manuals, logos, documentation, and associated intellectual property are owned exclusively by YGOP.
    The Applicant agrees that:
    • No part of the program may be reproduced, copied, distributed, published, modified, translated, or used for any personal, institutional, or commercial gain without the express written permission of YGOP.
    • The program will not be used outside the boundaries of the registered school(s) or for purposes other than those permitted under this Agreement.
    • All digital licenses and tools are non-transferable and shall remain the exclusive property of YGOP.

    5. Fees and Financial Obligations
    The Applicant agrees to:
    • Pay the full registration and implementation fee as invoiced by YGOP at least thirty (30) days prior to the scheduled program start date.
    • Understand that failure to remit payment within the required timeframe may result in a delay or cancellation of implementation without refund or liability to YGOP.
    • Assume responsibility for any bank fees, international transfer costs, or processing charges associated with the payment.

    6. Responsibilities of YGOP
    Upon receipt of payment and confirmation of school registration, YGOP shall:
    • Provide access to program curriculum, digital tools, app integrations, and training modules.
    • Customize the Golfers Gym digital tools with the school’s logo and branding where applicable.
    • Deliver ongoing technical support and communication throughout the implementation period.
    • Supply relevant outcome tracking tools and feedback mechanisms.

    7. Responsibilities of the Applicant
    The Applicant agrees to:
    • Integrate the program into their educational calendar and coordinate with staff to facilitate execution.
    • Ensure that the Golfers Gym system is used responsibly and ethically.
    • Protect all proprietary information shared by YGOP.
    • Support the expansion of the program by actively identifying or referring at least one additional school or district during or after their program term (“Pass It On” responsibility).

    8. Data Use & Confidentiality
    Any data collected during the implementation may be used by YGOP for monitoring, evaluation, reporting, and promotional purposes. However:
    • Student personal data will be anonymized.
    • YGOP will not sell or transfer sensitive institutional data to third parties without consent.

    9. Non-Compliance and Penalty
    If the Applicant breaches any term of this Agreement, including unauthorized use of program materials:
    • YGOP reserves the right to revoke access to the program and seek compensation or legal remedy.
    • The Applicant shall immediately cease all use of YGOP’s intellectual property upon written notice.

    10. Termination
    This Agreement may be terminated:
    • By YGOP, with immediate effect, upon written notice if the Applicant fails to comply with any terms herein.
    • By either Party, with 30 days’ written notice, for any reason. However, fees already paid shall be non-refundable unless YGOP fails to deliver its obligations.

    11. Limitation of Liability
    YGOP is not liable for:
    • Any damages, delays, or losses arising from misuse, technical errors, staff turnover, or external disruptions.
    • Injuries or accidents sustained during physical activity unless directly resulting from negligence by YGOP.

    12. Governing Law & Dispute Resolution
    This Agreement shall be governed by the laws of the United States of America, without regard to conflict of law principles.
    In the event of a dispute:
    • The Parties shall first attempt resolution through informal discussion.
    • If unresolved, the Parties agree to mediation in Kentucky before pursuing legal action.

    13. Entire Agreement
    This document represents the full understanding between the Parties and supersedes any prior agreements, verbal or written, concerning the subject matter. Amendments must be made in writing and signed by both Parties.
